Refund and Returns Policy

1. About This Policy

This Cancellation, Refund and Returns Policy applies to bookings made directly with Spear Surf through https://spearsurf.com, by email, through WhatsApp or through another direct booking channel.

It covers our Morocco surf camp packages, surf lessons, trips and activities in Tamraght, Taghazout and Imsouane. If you book through a third-party travel agent or booking platform, that provider’s cancellation terms may also apply. If there is a conflict, mandatory consumer rights and the terms presented to you before booking will take priority.

2. Cancelling Your Booking

To cancel, email admin@spearsurf.com and provide:

  • the name of the lead guest;
  • the booking reference, if available;
  • the scheduled arrival date; and
  • a clear statement that you wish to cancel.

Your cancellation takes effect when Spear Surf receives your email. All cancellation periods are calculated using Morocco local time and your scheduled arrival date.

3. Standard Cancellation and Refund Periods

Cancellation eight or more days before arrival

If Spear Surf receives your cancellation at least eight full calendar days before your scheduled arrival date, you are eligible for a refund of the amount paid to Spear Surf.

We may deduct a third-party cost only when it is genuinely non-refundable, directly connected to your booking and was clearly disclosed to you before you confirmed the booking. We will explain any deduction on request.

Cancellation seven days or fewer before arrival

If Spear Surf receives your cancellation seven calendar days or fewer before your scheduled arrival date, the booking is non-refundable and the cancellation charge is 100% of the booking amount.

This seven-day rule is subject to the mandatory consumer and package-travel rights described in section 11. Nothing in this policy removes a right that cannot legally be excluded.

Example

If your scheduled arrival date is 20 September:

  • a cancellation received on or before 12 September qualifies under the eight-or-more-days rule; and
  • a cancellation received from 13 September onwards falls within the non-refundable seven-day period.

4. No-Shows, Late Arrivals and Early Departures

No refund is available if you:

  • do not arrive for your booking;
  • arrive late or miss part of the programme;
  • leave before the booked departure date; or
  • choose not to use a lesson, trip, activity or other included service.

This does not affect your rights if Spear Surf fails to provide a booked service or if mandatory law provides otherwise.

5. Changes and Rescheduling

You may request a change of date, location, package or participant by emailing admin@spearsurf.com.

  • Requests received at least eight days before arrival are subject to availability and any reasonable, documented cost caused by the change.
  • Requests received seven days or fewer before arrival are not guaranteed. If we cannot accommodate the request, the standard cancellation rules apply.
  • A rescheduled booking may be subject to price differences for the new dates or package.

Where mandatory package-travel rules apply, you may have the right to transfer the booking to another eligible traveller after giving reasonable notice and paying only the reasonable cost caused by the transfer.

6. Illness, Injury and Travel Disruption

The standard cancellation periods apply if you cancel because of illness, injury, flight cancellation, transport delay, passport or visa problems, work commitments or another personal circumstance.

We strongly recommend comprehensive travel insurance covering surfing and other booked activities, medical treatment, trip cancellation, travel delays, lost baggage and emergency repatriation.

This section does not limit any mandatory right relating to unavoidable and extraordinary circumstances that significantly affect a legally qualifying package.

7. Surf Conditions, Weather and Safety

Surf lessons, trips and outdoor activities depend on weather, waves, tides, road conditions and safety assessments. Spear Surf may change the time, location, route or activity when reasonably necessary for safety or service delivery.

Where possible, we will offer a suitable replacement location, rescheduled session or comparable activity. A reasonable operational change does not automatically create a right to a full refund.

If Spear Surf cancels a material service and cannot provide a reasonable alternative, we will refund the portion of the booking price attributable to that unprovided service, unless you are entitled to a different remedy under mandatory law.

8. Cancellation by Spear Surf

If Spear Surf cancels your entire booking before arrival, you may choose:

  • a full refund of payments made to Spear Surf for the cancelled booking; or
  • an alternative date or package, subject to your agreement.

If we offer an alternative of lower value and you accept it, we will refund the difference. When cancellation is caused by unavoidable and extraordinary circumstances, Spear Surf will provide the refund required by applicable law but will not be responsible for additional compensation where the law permits this limitation.

Spear Surf is not responsible for independently booked flights, insurance, visas or other services purchased from third parties. You should make any related claim directly with the relevant provider or insurer.

9. Unsafe or Unacceptable Conduct

Guests must follow reasonable safety instructions and respect other guests, staff, local communities and property. Spear Surf may suspend or end a guest’s participation when their behaviour creates a serious safety risk, involves unlawful conduct, harassment or violence, or seriously disrupts the programme.

No refund is due for services lost because of the guest’s serious misconduct, subject to applicable law.

10. Refund Method and Timing

Approved refunds will be returned to the original payment method whenever reasonably possible. Spear Surf will initiate an approved refund without undue delay and normally within 14 calendar days after confirming the cancellation and refund entitlement.

Banks and payment providers may require additional processing time before the funds appear in your account. Spear Surf is not responsible for exchange-rate differences or charges imposed by your bank or payment provider.

11. Mandatory Consumer and Package-Travel Rights

Spear Surf operates from Morocco. Moroccan consumer-protection law may apply to your booking. Depending on how a booking is sold, where the customer lives and which services are combined, mandatory UK, European or other consumer and package-travel rules may also apply.

Where applicable, these rules may give travellers rights that override part of this policy, including rights relating to:

  • unavoidable and extraordinary circumstances significantly affecting a qualifying package or travel to the destination;
  • cancellation or significant changes made by the organiser;
  • appropriate and justifiable cancellation charges;
  • services that are not provided as agreed; and
  • refund deadlines.

Nothing in this policy excludes or limits a statutory right or liability that cannot lawfully be excluded or limited.

12. Returns

Spear Surf currently sells bookings for time-specific services, including camp packages, surf lessons, trips and activities. These services cannot be physically returned, so a product-return policy does not apply.

If Spear Surf later sells physical products, the applicable return conditions will be provided separately before purchase.
